Terms of Service — The Product Geek App

Overview

These Terms of Service ("EULA") govern your use of The Product Geek mobile application ("the App"), operated by Arindam Nath ("I", "me", or "my"). By creating an account or using the App, you agree to these terms. If you do not agree, do not use the App.

You acknowledge that this EULA is concluded between you and Arindam Nath only, and not with Apple Inc. Arindam Nath, not Apple, is solely responsible for the App and its content.

1. What the App Does

The Product Geek delivers one product management case study per day. You read a scenario, select a response option, and receive pre-authored expert feedback. The purpose is to build product management judgment through daily practice.

 

2. Eligibility

You must be at least 18 years old to use the App. By registering, you confirm that you meet this requirement.

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

 

3. License

Subject to your compliance with these Terms, you are granted a limited, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. This license may not be sublicensed. The App may be accessed by other accounts associated with you via Family Sharing or volume purchasing where permitted by Apple.

 

4. Your Account

You are responsible for keeping your login credentials secure. You must not share your account with others or allow others to access the App through your account. I reserve the right to suspend or terminate accounts that show signs of misuse.

 

5. Subscriptions and Payments

Free tier: The App offers free access to daily cases and feedback.

Paid subscription: Premium features (including Case Pattern Analysis) are available via a recurring subscription purchased through Google Play (Android) or the App Store (iOS). Pricing and billing cycles are shown at the point of purchase.

Billing: Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. Cancellations take effect at the end of the current billing period — you retain access until then.

Refunds: All refund requests are handled according to Google Play's or Apple's refund policies, as applicable. I do not process refunds directly.

Price changes: I will give you at least 30 days' notice of any price increase, via the App or email.

 

6. Maintenance and Support

Arindam Nath is solely responsible for providing maintenance and support services for the App, as described in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

 

7. Warranty

The App is provided on an "as is" basis. While I aim for daily availability, I do not guarantee uninterrupted access. I am not responsible for losses resulting from service downtime, content errors, or your reliance on the feedback provided.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Arindam Nath.

 

The feedback content in the App represents experienced product management perspectives, not professional consulting advice. It is educational in nature.

 

8. Product Claims

You and Arindam Nath acknowledge that Arindam Nath, not Apple, is responsible for addressing any claims relating to the App or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

 

9. Intellectual Property

You and Arindam Nath acknowledge that, in the event of any third-party claim that the App or your use of it infringes a third party's intellectual property rights, Arindam Nath, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

 

All case studies, feedback content, scoring frameworks, and other materials in the App are original works owned by Arindam Nath. You may not reproduce, distribute, or commercially use any content from the App without written permission.

You may share screenshots of your personal progress (scores, streaks) for personal use and non-commercial social sharing, provided you credit The Product Geek.

 

10. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App

  • Scrape, copy, or systematically extract case content or feedback

  • Use the App in a way that could damage, disable, or impair the service

  • Attempt to gain unauthorised access to other users' accounts or data

  • Use the App for any unlawful purpose

When using the App, you must comply with applicable third-party terms of service, including your wireless carrier's data service agreement.

 

11. Limitation of Liability

To the maximum extent permitted by applicable law, Arindam Nath shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including lost career opportunities or decisions made based on the content.

My total liability to you for any claim arising from these terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

 

12. Account Deletion

You may delete your account at any time from within the App under Profile > Delete Account. Upon deletion, your account and all associated data will be permanently removed. Paid subscription access continues until the end of your current billing period, after which no further charges will occur.

 

13. Termination

I may suspend or terminate your account if you violate these Terms. Upon termination, your access ends immediately. Paid subscription access continues until the end of your current billing period.

 

14. Third-Party Beneficiary

You acknowledge and agree that Apple Inc. and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

 

15. Changes to These Terms

I may update these Terms from time to time. If changes are material, I will notify you via the App or email at least 7 days before they take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.

 

16. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of courts in India.
